Our Family Law Services Cover All Your Needs

Divorcing spouses and parents who are breaking up all have access to Colorado family courts. We can effectively guide everyone through the family law process. If you need help with the following, give our Centennial family law attorneys a call.

Child Custody

When the parents of a child don’t live under the same roof, they may need legal help to establish their parenting rights and responsibilities. In a child custody case, also called an allocation of parental responsibilities case, the court makes decisions regarding the following:

  • How much parenting time each parent will have,
  • Who will have physical custody of the child, and
  • Who will have decision-making rights.

The court makes these decisions based on what’s in the best interests of the child, which takes into account:

  • The child’s adjustment to their home, community, and school;
  • Each parent’s health;
  • The wishes of the parents;
  • Any history of domestic abuse involving any of the parties;
  • The child’s health;
  • Each parent’s ability to care for the child and foster a relationship between the child and the other parent (if appropriate);
  • The child’s wishes; and
  • The child’s relationship with each parent, other family members, and other significant figures in their life.

These issues can be difficult to discuss, and proving your custody rights could require detailed paperwork and expert opinions. Our Centennial family law lawyers can fulfill your needs by asserting your custody rights.

Child Support

When a court determines each parent’s right to custody and parenting time, it also decides their obligations regarding child support. Family law judges look at the following to determine who will pay child support and how much they will pay:

  • Each parent’s income,
  • The child’s financial needs, and
  • Each parent’s custody rights.

Typically, a parent’s child support obligation lasts until the turns 19 or otherwise emancipates. However, a support order can last after the child’s 19th birthday if the parents agree to extended support or the child has special needs in adulthood.

Divorce

In a divorce case, you will need to either negotiate or litigate a final resolution before you receive a decree. The issues you may need to resolve are as follows:

  • Division of marital property between you and your spouse,
  • Child custody,
  • Child support, and
  • Spousal support (also called alimony).

As we noted, child support and custody cases can require a complex analysis of each parent’s resources and abilities and each child’s needs. And just like child custody and support issues, the division of a marital estate and determinations regarding spousal support can be complicated, especially if a couple has significant or complex assets.

Division of Marital Property

When a couple divorces, the court determines what property is separate and what property is marital. Typically, the court sets aside, to each spouse, their separate property and divides the marital property between them.

Generally speaking, your separate property is what you owned before marrying and what you inherited while married, and your marital property is what you acquired during the marriage.

Distinguishing these types of property can be difficult if you and your spouse have several assets or have commingled your assets. We have the experience and access to financial professionals to properly categorize all assets in your divorce and ensure you receive a proper share of the marital property.

Spousal Maintenance

If you want spousal maintenance, you must request it from the court. The pivotal factor will be the spouses’ incomes, though the court can look at other statutory factors. Our knowledgeable centennial family lawyer can help protect your rights regarding spousal maintenance, regardless of which side of the case you may be on.

Modification of Family Court Orders

Rarely are family law cases one-and-done matters. As your children grow and your financial needs change, you can ask the court to modify your orders. At Plog & Stein, P.C., our goal is to be there for our clients, meeting their family law needs even after their initial divorce or child custody case is done.
