The court will primarily be focused on dividing “marital property.” Marital property includes assets and debts acquired during the marriage. Some types of property will be considered separate property. Specifically, the court won’t consider gifts or inheritances or property either spouse acquired after separation. Separate property may also include assets and debts covered by pre-nuptial, post-nuptial, or other marital agreements.

How Do I File for Divorce in Castle Rock, Colorado?

In Colorado, a divorce is referred to as a “dissolution of marriage.” To start the process of divorce in Castle Rock, you or your spouse must complete the necessary paperwork. Filing for divorce means you complete a petition for dissolution of marriage. This form can be filled out by one or both spouses. Whoever completes the form is the petitioner. If you both complete the form together, one spouse is the petitioner and the other is the co-petitioner.

The dissolution of marriage form requires you to provide information about both spouses, residency, children (if any), any other pending court cases, and the status of the marriage. Colorado is a no-fault divorce state. There is no requirement to prove that either spouse did something wrong to lead to divorce. The parties must state that the marriage is “irretrievably broken” without any chance of reconciliation.

If you are filing individually, you must also serve the other spouse with the petition. Serving your spouse means delivering a copy of the petition to the other spouse. The court will then know that the other spouse has received a copy and is aware of the divorce initiation. You can use a sheriff to deliver a copy of the papers to your spouse and request verification of delivery. If you are co-petitioners, there is no need to serve a copy of the petition.

Once the initial paperwork is done, you will need to disclose certain financial information. Then the process will include court dates, negotiations, and agreements. How Long Do I Have to Live in Castle Rock Before I Can File for Divorce?

Some factors to determine a person’s intent to remain permanently in Colorado include: voter registration, vehicle registration, driver’s license, owning property in Colorado, or state tax filings.
