Broomfield Divorce and Child Custody Cases

In the state of Colorado, a divorce may be uncontested or contested. An uncontested divorce takes place when a couple agrees on all of the terms of the divorce. Once this occurs, the spouses file a Separation Agreement with the Court that clearly highlights each of the issues that have been settled. The agreement does not become binding until a judge approves it. A contested divorce happens when the parties cannot agree on a number of issues. In these cases, the court will examine the situation and make a final decision on the contested issues. A judge typically has broad discretion to consider a variety of factors when making any decision, whether financial or child custody related.

Of course, this takes a meeting-of-the minds and a willingness on the part of each spouse to reach an amicable resolution. Couples who do not wish to divorce may opt for a legal separation, which is sometimes chosen for religious or pragmatic reasons, such as health insurance. The process of legal separation is similar to dissolution and begins with filing a petition notifying the court and the other spouse. Just as with divorce, you or your spouse must have resided in Colorado for at least 91 days prior to filing for a legal separation. The same asset, support, and custody issues present in a divorce are also dealt with via the legal separation process. When minor children are involved, child custody matters will need to be decided, whether in a separate case or as part of the divorce process. In Colorado, the term “custody” has been replaced with the term “parental responsibility” by statute. All custody determinations in this state are to be based on what is in the best interest of the child. A court may consider any factor that is deemed to be relevant to the child’s best interest, including the wishes of the child, the wishes of each parent, the household environment of each parent, where the child goes to school, the community of the child, and the mental and physical health of all of the parties. Custody and visitation orders expire when the child turns 18. However, child support generally continues until a child turns 19 years of age.
