Colorado Springs rests in the 4th Judicial District of Colorado. The laws of Colorado apply throughout the state, including El Paso County. The primary statutory section tied into divorce, custody, and child support cases is Colorado Revised Statutes, 14-10-101, the “Uniform Dissolution of Marriage Act.”

In a divorce case, you can expect to deal with issues regarding division of marital property, allocation of marital debt, and spousal support (called “maintenance” under Colorado statute). If there are children involved, or if you are dealing with a child custody case (allocation of parental responsibilities), you can expect to deal with issues regarding decision-making, allocation of parenting time and residential custody, and child support. Though typically the final division of marital property and debts is permanent, any of the other issues may require further court intervention as time goes by. For example, child support may be modified until a child turns 19 years of age. Alimony may be modifiable as to both amount and duration, based on a change in circumstances. Parenting time and decision-making orders are modifiable until a child turns 18.

The completion of your divorce or child custody case may be the first phase of a series of rounds of litigation over time. It’s not uncommon for issues related to enforcement or modification of orders to arise down the road.
